HKIAC公布4年期间仲裁程序费用和时长

香港国际仲裁中心(“HKIAC正式发布HKIAC仲裁程序平均费用和时长的最新报告。以下数据反映了HKIAC2013111日至20171231日间(下称“相关期间”),根据2013年版《HKIAC机构仲裁规则》(下称“《规则》”)进行管理的、并作出最终裁决的案件。

2. 以下为数据采集办法:

  • 在相关期间内按照《规则》以最终裁决结案的仲裁案件有62起。在这62起案件中,有10起是按照《规则》的简易程序进行的。

  • 在相关期间内按照《规则》以紧急仲裁员决定结案的紧急仲裁案件有5起。·        所有依照当时人和解协议作出的合意裁决而结案的仲裁案件,包括紧急仲裁案件,已排除在本报告之外。

  • 仲裁时长指的是从仲裁启动的日期到最终裁决之日的期间,包括任何中间程序暂停时间。 

  • 紧急仲裁时长指的是从紧急仲裁启动的日期到紧急仲裁员决定之日的期间,包括任何中间程序暂停时间。

  •  仲裁费用仅包括仲裁庭的费用和HKIAC的案件受理费和管理费。

  •  紧急仲裁费用仅包括紧急仲裁员的费用和HKIAC的案件管理费(即没有指定紧急仲裁员的受理费)。

  •  在《规则》下,当事人可选择如何支付仲裁庭的费用,即按小时收费(上限为每小时6,500港元或约830美金)或按争议金额大小计算。在绝大多数案件中,HKIAC仲裁庭按小时收费。

  •  本报告中的费用和时长数据以中间值和平均值的形式显示。中间值是指一组数据中在最中间的数字。平均值是指在一组数据中所有数字的总和除以数字的总量。考虑到相关数据的分布,中间值相对而言更有意义和说服力,因为其降低了边缘数值对整套数据准确性的影响。 

3. 以下是56起仲裁庭按小时收费的案件和6起仲裁庭按争议金额大小收费的案件中仲裁费用的平均值和中间值。

HKIAC Average Costs and Duration

The Hong Kong International Arbitration Centre (“HKIAC”) is pleased to release an updated report on the average costs and duration of an HKIAC arbitration. The data below reflects all cases administered by HKIAC under the 2013 HKIAC Administered Arbitration Rules (the “Rules”) in which a final award was issued between 1 November 2013 and 31 December 2017 (the “Relevant Period”). The overall findings are listed below.

The following methodology was used to produce the data:

  • 62 arbitrations under the Rules that were concluded by final award during the Relevant Period have been identified for the purposes of this report. Of the 62 arbitrations, ten were conducted under the expedited procedure of the Rules.

  • Five emergency arbitrator arbitrations under the Rules that were concluded by emergency arbitrator decision during the Relevant Period have been identified.

  • All arbitrations that were concluded by consent award based on parties’ settlement agreements, including emergency arbitrator arbitrations, have been excluded from this report.  

  • Duration of Arbitration refers to the period between the date of commencement of the arbitration and the date of the final award, inclusive of any stay periods.

  • Duration of Emergency Arbitration refers to the period between the date of commencement of the emergency arbitrator arbitration and the date of the emergency arbitrator decision, inclusive of any stay periods.

  • Costs of Arbitration include the arbitral tribunal’s fee and HKIAC’s registration fee and administrative fee only. 

  • Costs of Emergency Arbitration include the emergency arbitrator’s fee and HKIAC’s administrative fee only (there being no registration fee for emergency arbitrator appointments).

  • Under the Rules, parties have the option of paying arbitral tribunals’ fees by hourly rate (capped at HK$6,500 or approximately US$830) or by reference to an ad valorem fee scale. The vast majority of HKIAC tribunals are paid on an hourly rate basis.

  • Costs and duration in this report are presented by both median and mean numbers for completeness. The median is the middle number of a set of values. The mean is the sum of all of the values in a set of data, divided by the number of values. Given the distribution of the data concerned, the median value is the more meaningful and robust value, as it minimises the skewing effect of outliers.    

Below are the mean and median costs of 56 arbitrations in which the arbitral tribunal was paid by hourly rate and those of 6 arbitrations in which the arbitral tribunal was paid by reference to an ad valorem fee scale.
