南非国会通过《国际仲裁法案》(南非)

20171024日,南非国会通过了《国际仲裁法案》,该法案提出以《联合国国际贸易委员会示范法》作为南非国际仲裁制度的基础。

随后,司法与矫正服务投资委员会(Portfolio Committee on Justice and CorrectionalServices)出具了一份有关《法案》的研究报告。2017421日,该委员会收到了供审议的《法案》并于912日在国会举行公开听证会。委员会对《法案》的研究报告(其中提出了修改意见)发表在1020日的《Announcements》、《Tablings》和国会委员会报告的报纸上。

南非现有的国际仲裁制度备受诟病。目前,南非的国际仲裁程序仍适用《1997年承认与执行外国仲裁裁决法》的规定,这已经跟不上国际的发展趋势。此外,还有人认为《1965仲裁法》已经过时,不能充分实现国际仲裁的目的并需要通过修正以满足当代商业的需求。

1998年,南非法律改革委员会建议,南非应采纳一部《示范法》对涉及国际仲裁程序的国内法进行协调。

《法案》提议将联合国国际贸易委员会颁布的《国际商事仲裁示范法》并入南非法律。这是为了对外国仲裁裁决的承认和执行进行重新规定,废除《1977年承认与执行外国仲裁裁决法》并对《1978年商业保护法案》进行修改。

《法案》现将提交国家委员会审议。若全国省事务委员会通过了该法案且未作任何修订,则该法案应提交总统批准。

NATIONAL ASSEMBLY PASSES INTERNATIONAL ARBITRATION BILL

Parliament,Tuesday 24 October 2017 – The National Assembly at its sitting today passed theInternational Arbitration Bill, which proposes incorporating the Model Law ofthe United Nations Commission on International Trade Law as the cornerstone ofinternational arbitration in South Africa.

This followed areport on the Bill from the Portfolio Committee on Justice and CorrectionalServices. The Committee received the Bill on 21 April 2017 for considerationand report and held public hearings on it on 12 September, at Parliament. Thecommittee’s report on the Bill, with proposed amendments, was published in the20 October Announcements, Tablings and Committee Reports parliamentary paper.

South Africa’sexisting international arbitration regime has been criticised. The Recognitionand Enforcement of Foreign Arbitral Awards Act 40 of 1977, which currentlyregulates international arbitration in South Africa, is not in line withinternational developments. Concerns have also been raised that the ArbitrationAct of 1965 is inadequate for international arbitration purposes, is outdatedand needs revision to meet modern commercial needs.

In 1998 theSouth African Law Reform Commission recommended that South Africa adopt a ModelLaw, which would harmonise national laws related to international arbitrationprocedures.

The Billprovides for incorporating the Model Law on International CommercialArbitration, as adopted by the United Nations Commission on International TradeLaw, into South African law. This is to provide for the recognition andenforcement of foreign arbitral awards, to repeal the Recognition andEnforcement of Foreign Arbitral Awards Act of 1977 and to amend the Protectionof Businesses Act of 1978.

The Bill willnow be referred to the National Council for consideration. If the NationalCouncil of Provinces passes the Bill without amendments the Bill must besubmitted to the President for assent.
